Anti-Spam Policy

Keplars has a zero tolerance policy toward spam and unsolicited email. This policy exists to protect our infrastructure, our customers, and the recipients of emails sent through our platform.

Our Commitment

Keplars maintains a strict Zero Tolerance Spam Policy. We are committed to ensuring our platform is used only for legitimate, permission-based email communication. Spam harms recipients, damages sender reputations, and degrades deliverability for everyone on shared infrastructure.

By using Keplars, you agree that all emails sent through our platform will comply with this policy and all applicable anti-spam laws, including the CAN-SPAM Act, GDPR, CASL, and any other relevant regulations in your jurisdiction.

Prohibited Sending Practices

The following are strictly prohibited on Keplars and will result in immediate account suspension without refund:

  • Sending unsolicited bulk email (spam) to any recipient
  • Sending to purchased, rented, scraped, or harvested email lists
  • Sending to recipients who have not explicitly opted in to receive your communications
  • Sending phishing emails, malware, or deceptive content
  • Impersonating another person, brand, or organization
  • Sending to lists with high bounce rates or spam complaint rates
  • Bypassing or suppressing unsubscribe requests
  • Disguising the origin or routing of email messages
  • Using false or misleading subject lines or From addresses

Permission & Consent Requirements

All recipients must have given clear, affirmative consent to receive emails from you. Acceptable forms of permission include:

  • Explicit opt-in via a signup form where the subscriber requested your emails
  • Transactional consent — recipients who have a direct business relationship with you (e.g., customers, users)
  • Double opt-in confirmation for marketing and newsletter communications
  • Clear disclosure at the point of data collection about the type of emails they will receive

Implied or assumed consent is not sufficient for marketing communications. You must be able to demonstrate consent if asked.

CAN-SPAM & GDPR Compliance

All emails sent through Keplars must comply with applicable regulations. Key requirements include:

  • Include a valid physical mailing address in every marketing email
  • Include a clear and functional unsubscribe mechanism in every marketing email
  • Honor unsubscribe requests within 10 business days
  • Use accurate From, Reply-To, and routing information
  • Clearly identify promotional content as advertising where required
  • For EU recipients, comply with GDPR requirements including lawful basis for processing and data subject rights
  • For Canadian recipients, comply with CASL express consent requirements

Monitoring & Enforcement

Keplars actively monitors sending patterns and complaint rates to protect platform deliverability for all users. Enforcement measures include:

  • Automated detection of abnormal sending patterns, spike volumes, and complaint rates
  • Manual review triggered by spam complaints or reported abuse
  • Immediate account suspension for confirmed violations
  • Permanent account termination for repeated or severe violations
  • No refund is issued for accounts suspended due to spam or abuse violations
  • Restriction decisions are final and not subject to dispute

Keplars reserves the right to throttle, block, or terminate any account at any time if we determine its sending activity poses a risk to platform reputation or other users.

Consequences of Violations

Violations of this Anti-Spam Policy carry serious consequences:

  • Immediate suspension or permanent termination of your Keplars account
  • Forfeiture of any remaining prepaid subscription value (no refund)
  • Potential reporting to relevant authorities or anti-spam organizations
  • Blacklisting of associated sending domains and IP addresses
  • Legal action where applicable under applicable anti-spam laws

The forfeiture of subscription value is an intended consequence of policy violations. This policy exists to protect the deliverability and reputation of the platform for all legitimate senders.

Report Spam or Abuse

If you have received unsolicited email that appears to have been sent via Keplars, or if you are aware of a Keplars account being used to send spam, please report it immediately.

We investigate all abuse reports and take appropriate action. Reporting spam helps us keep the platform clean for legitimate senders.
